AUSTIN – The Supreme Court of Texas reversed an appeals court decision Dec. 7, 2017, addressing the power of the court in the political question doctrine after a military dog bit a woman on a base in Afghanistan.
AUSTIN –The Texas Supreme Court upheld the 4th Court of Appeals decision that a city cannot impose an ordinance banning single-use plastic or paper bags by merchants, a ruling that could end the statewide single-use bag bans.
Texas’s employment discrimination statute (the Texas Commission on Human Rights Act, codified in the Texas Labor Code at section 21.001 et seq.), like its federal counterpart (Title VII of the Civil Rights Act of 1964, 42 U.S.C. section 2000e et seq.), prohibits discrimination on the basis of enumerated characteristics, including “sex.” Accordingly, an employer is forbidden to treat an applicant or employee differently because of that person’s sex. Without a sex-based nexus, the employer’s conduct may be rude, unfair, obnoxious, boorish, or insensitive, but will not constitute illegal sex discrimination.
AUSTIN – In an opinion delivered Feb. 2, the Texas Supreme Court overturned the dismissal of a woman’s medical malpractice lawsuit after it was dismissed by a court of appeals on the grounds that her expert report was deficient.

The long-awaited decision from the Texas Supreme Court in the school finance case, Morath v. Texas Taxpayer and Student Fairness Coalition, was issued on May 13, 2016. (The case was argued over eight months earlier.) The court’s jargon-laden 100-page (!) decision can be summarized with this sentence: “Despite the imperfections of the current school funding regime, it meets minimum constitutional requirements.”
With campaign finance reports in for the first three weeks of January, records show at least two out of the three incumbent Texas Supreme justices up for re-election this year hold a financial edge over their Republican challengers.
