A couple has sued General Motors, alleging product negligence.
Nancy Littlefield and Ricky Littlefield of Henderson filed a lawsuit May 28 against General Motors of Austin in the Marshall Division of the Eastern District, alleging breach of warranty.
According to the complaint, on June 7, 2013, Nancy Littlefield was driving a 2012 Chevrolet Traverse westbound on U.S. Route 80 in Upshur County when she was struck by another vehicle. The suit says the plaintiff was properly seated and wearing her seat belt but was severely injured when her vehicle failed to protect her.
The suit maintains Littlefield's vehicle was not crash-worthy and GM should have known of the possibility of unintended but foreseeable accidents along with safer alternative designs. The plaintiff holds GM responsible for damages.
Specifically, Littlefield alleges: the vehicle violated safety provisions; its airbag failed to deploy; its structure was weak, inferior or dangerous; and GM failed to test and analyze the vehicle to assure crash-worthiness.
Nancy Littlefield cites pain, suffering, impairment, disfigurement, interference with daily activities and a reduced capacity to enjoy life, plus impaired earning capacity and lost wages. Ricky Littlefield alleges loss of care, support, services and companionship, plus mental anguish.
The Littlefields seek compensation in excess of $75,000 for actual damages, pre- and post-judgment interest, attorney fees, expenses and costs.
