Seaman cites employers in gangway accident

A Louisiana seaman has sued three companies, alleging liability in a workplace accident.

Jamie Arabie filed a lawsuit June 3 in Galveston County District Court against McDermott Inc., Gabriella USA, and Gulf Copper & Manufacturing Corporation, alleging liability in a March workplace accident.

According to the complaint, on March 25, Arabie, employed by the defendants on their marine vessel, sustained serious neck and back injuries in a fall on the gangway. The suit cites the defendants with: failure to provide a safe workplace with adequate entry and exit; supervise and properly train their crew; provide proper equipment and medical treatment; and maintain the vessel in an adequate condition. The suit further cites violation of OSHA and Coast Guard rules.

The plaintiff alleges severe pain, mental anguish, impairment and discomfort, lost wages and earning capacity and medical expenses. He maintains he is entitled to maintenance and cure under the Jones Act and the defendants have willfully denied coverage.

Arabie plaintiff seeks more than $1 million in compensation for punitive damages, maintenance and cure, pre- and post-judgment interest, attorney fees, expenses and costs. He is represented by attorney Sean O’Rourke of Simon-O’Rourke in Houston.
