Business owner alleges negligence in intersection crash

Galveston county courthouse

A Galveston County business owner is suing a commercial driver and his insurance carrier, alleging vehicular negligence.

Bruce Alan Munden and Tube Lining Technology Inc. filed a lawsuit June 10 in Galveston County District Court against Ronnie Stanley of Marietta, Georgia, and Southern County Mutual Insurance Company, alleging liability in a 2013 traffic incident.

According to the complaint, on Nov. 21, 2013, Stanley failed to yield the right of way to Munden at the intersection of 14th Street and Avenue B in Galveston, resulting in a collision. The suit says Stanley failed to: apply his brakes; turn to avoid impact; control his vehicle; and maintain a proper lookout.

The lawsuit states Munden, 64 at the time, sustained: physical and mental pain and suffering; anguish, impairment and disfigurement; loss of wages and earning capacity; and diminished ability to perform household services, along with medical expenses. The plaintiff further alleges damage to his business and makes a claim against Southern County Mutual for the defendant allegedly being under-insured.

Munden seeks actual damages, pre- and post-judgment interest, attorney fees, expenses and costs. He is represented by attorneys Alton C. Todd of The Law Firm of Alton C. Todd in Friendswood; and S.R. Lewis Jr. of Lewis and Williams in Houston.

Galveston County District Court case number 15-CV-0588.
