Trio sues Beaumont and driver over injuries in motor collision

Three individuals filed a lawsuit against a municipality and its employee alleging negligence in a 2013 automobile crash that they claim severely injured them.

Joshua Bean, Nancy Hulett and Elizabeth Alexander filed a complaint against the city of Beaumont and Edward Stuart in Jefferson County District Court on June 16, claiming liability in a December 2013 collision.

According to the suit, Stuart was operating a motor vehicle in the scope of his employment with the xity of Beaumont on or about Dec. 20, 2013 when the accident occurred, details of which were not specified in the filing.

The complaint states that Stuart was in breach of ordinary care when he operated his vehicle unsafely by failing to yield the right of way, keep a proper lookout, apply brakes in a timely manner, turn his vehicle to avoid impact, or maintain a safe distance or control his speed. The City of Beaumont is blamed as a proximate cause of the accident for failure to properly instruct and train its driver.

Alleging pain, mental anguish, impairment and disfigurement, lost wages and earning capacity, medical expenses, and property damage, the plaintiffs seek over $250,000 in compensation for damages, pre- and post-judgment interest, attorney’s fees, expenses, and costs.
