A Jefferson County man is suing over claims a bail bond service transferred his call to an affiliated attorney to solicit business without his consent.
Brandon Nash filed a lawsuit Oct. 1 in Jefferson County District Court against Kubosh Bail Bonding, Kubosh Law Office and Paul and Felix Michael Kubosh, citing civil barratry.
According to the complaint, Felix Kubosh, doing business as Kubosh Bail Bonding, regularly refers clients to Paul Kubosh at Kubosh Law Office, which is next door, and they even shared a phone system. Nash says he called Kubosh Bail Bonding on Oct. 9, 2012, and inquired after bail bonds but he was put on hold and, without his consent or knowledge, his call was transferred to Kubosh Law Office.
Nash says he came into telephone contact with the law office, a representative of which gave him a quote for bail bonds which included legal representation. The defendants are accused of civil barratry in soliciting Nash's business without his consent or asking.
Nash seeks a $10,000 penalty from Paul Kubosh, another $10,000 penalty from Felix Kubosh, actual damages and attorney fees.
He is represented by attorneys Brian Zimmerman and David A. Talbot III of Zimmerman, Axelrad, Meyer, Stern and Wise in Houston.
