DeMontrond RV accuses multiple government entities of erroneous tax assessment

DeMontrond Buick Company, operating as DeMontrond RV, has filed a lawsuit against several governmental entities in Harris County, Texas, over what it claims are erroneous tax assessments on its business property. The complaint was lodged by DeMontrond Buick Company in the District Court of Harris County on April 25, 2025, targeting defendants including Harris County and other related entities.

The case revolves around a disputed appraisal for the 2020 tax year. DeMontrond Buick Company asserts that the Appraisal Review Board incorrectly valued its business personal property at $5,148,980 for their location at 19333 North Freeway, Spring, Texas. However, the company contends that no such property existed at this address as of January 1, 2020. The plaintiff argues that this error led to an unjust tax assessment and subsequent financial burden. Despite appealing to correct this discrepancy under Section 25.25(c) of the Texas Property Tax Code and pursuing administrative remedies with the Harris County Appraisal District (HCAD), their efforts were initially denied by the Review Board.

Following a diligent pursuit of legal action against HCAD in July 2022, some corrections were made to DeMontrond's account #233-199-370-0000. Nevertheless, they claim approximately $43,510.26 remains outstanding from various defendants who have yet to refund these erroneously collected taxes. The breakdown includes amounts owed by Harris County itself ($20,140.75), the Flood Control District ($1,617.81), Port Houston ($510.26), Harris Health System ($8,583.86), Department of Education ($257.09), Lone Star College ($5,540.60), and Emergency Corps ($6,849.89).

DeMontrond Buick Company is seeking monetary relief within the jurisdictional limits of $250,000 or less and is requesting attorney’s fees under Chapter 38 of the Texas Civil Practice and Remedies Code due to what they describe as an open account where funds were wrongly collected by these entities without subsequent reimbursement despite repeated demands.

The lawsuit calls for a judgment against all defendants jointly and severally for not only the principal sum but also interest accrued due to delays in payment along with attorney’s fees and court costs incurred during this process.
