Woman says she tripped on apartment complex sidewalk

A Jefferson County woman is suing over claims she was injured on the sidewalk of her apartment complex.

Helen Feathers filed a lawsuit Oct. 2 in Jefferson County District Court against Harbour Apartments and BH Management Services, doing business as The Harbour Apartments, and M.W. Rogers Construction Inc., citing negligence.

According to the complaint, Feathers was residing in Harbour Apartments where M.W. Rogers Construction had been hired to install new sidewalks. The complaint states the area where the work was to take place was taped off but the area for Feathers to walk had a stake stuck in the ground, which she did not see and tripped over it on Jan. 12, 2013.

Feathers says she sustained injuries to her neck, shoulder and knee. The defendants are accused of negligence in failing to maintain the premises in a safe manner or warn the public of the dangerous condition, the suit states.

Feathers seeks more than $100,000 in damages, including medical expenses and loss of earning capacity, interest and costs of court.

She is represented by attorney Tom Oxford of Waldman Smallwood in Beaumont.
