Plaintiff injured party sues LVL Up Towing LLC over negligence

Ana Reino has taken legal action against a Texas-based towing company and one of its employees, following an incident that left her with severe injuries. On March 20, 2025, Reino filed a complaint in the District Court of Harris County, Texas, naming John Doe and LVL Up Towing LLC as defendants. The case centers around allegations of negligence and seeks substantial damages for the harm caused.

According to the petition, on December 15th, John Doe was operating a vehicle within his employment scope at LVL Up Towing LLC when he allegedly failed to maintain proper control and speed. This resulted in him striking Ana Reino as she was retrieving belongings from her vehicle. Reino claims that Doe's actions were negligent, careless, and reckless, leading to her injuries. She accuses Doe of failing to keep a proper lookout, not controlling his speed, and driving recklessly with disregard for others' safety. The plaintiff asserts that these actions violated Texas Transportation Code § 545.351 which mandates safe driving practices.

Reino is seeking damages exceeding $250,000 but not more than $1 million. Her claims include negligence per se against John Doe for violating traffic laws designed to protect individuals like herself from such accidents. Additionally, she holds LVL Up Towing LLC vicariously liable under the doctrine of respondeat superior since Doe was acting within his employment scope during the incident.

The lawsuit also accuses LVL Up Towing LLC of negligent hiring, training, supervision, retention, and entrustment concerning John Doe. Reino argues that the company failed in its duty to ensure that Doe was fit for his role and posed no unreasonable risk to others. As a result of these alleged failures by both defendants, Reino suffered significant physical pain and impairment alongside financial losses due to medical expenses and lost earnings.

In her prayer for relief, Ana Reino requests judgment against both defendants for damages within the court's jurisdictional limits. She seeks compensation for past and future medical expenses, physical pain and suffering, loss of earnings capacity, disfigurement, mental anguish among other damages listed in her petition.
