Woman trips on unpainted curb at Home Depot

A Galveston County woman is suing over claims she was injured when she tripped on an unpainted curb at The Home Depot.

Jacqueline Byron filed a lawsuit Oct. 22 in Galveston County District Court against HD Development Properties, citing negligence.

According to the complaint, Byron was walking through the parking lot before clocking in to work at her job at the Home Depot on South Gulf Freeway in League City on April 29, 2012, when she tripped and fell over an unpainted curb. Byron says she sustained injuries to her shoulder, arm, knee, and ribs and had to undergo shoulder surgery related to the injury in September.

The defendant is accused of negligence in failing to warn visitors of the dangerous condition or paint the curb a different color than the rest of the parking lot.

Byron seeks actual damages, including medical and pharmaceutical expenses and loss of earning capacity, and costs of court.
