On Monday, a Beaumont judge ordered AT&T Mobility and a plaintiff who allegedly tripped at its Port Arthur store into mediation.
On June 19, Vergie Stelly filed suit in Jefferson County District Court against New Cingular Wireless PCS LLC, doing business as AT&T Mobility, and Celina Dotson.
According to the complaint, Stelly was on AT&T’s property at 8445 Memorial Blvd., Suite 100, in Port Arthur on July 17, 2013, when she tripped on an outdoor banner stand and was injured.
Court records show that on Jan. 26 Stelly filed a motion for mediation, stating mediation will promote a peaceable resolution of the suit but the parties cannot agree on a date.
Less than a week later, Judge Kent Walston, 58th District Court, granted the motion, ordering that mediation shall be completed by April 8.
The suit accuses the defendants of failing to properly supervise employee Dotson in the stand’s placement, failing to exercise due care in the stand’s placement and negligently placing the stand in a manner to create a hazard.
Stelly is seeking damages in excess of the minimum jurisdictional limits, interest and costs.
