Man says acne medicine not properly labeled

A Hardin County man is suing Wal-Mart and a pharmaceutical company over claims they failed to properly warn him that the acne treatment BenzaClin could cause ulcerative colitis.

Bradley Bennett filed a lawsuit Jan. 7 in the Beaumont Division of the Eastern District of Texas against Wal-Mart Stores Inc. and Sanofi-Aventis U.S., citing their provision of insufficient information regarding the risks of using BenzaClin.

According to the complaint, Bennett used the drug from 2007 through 2009 based on printed information provided by the defendants. Bennett, and his physicians, were unaware that the defendants did not include in their warnings the risk of ulcerative colitis, which was mandated by the FDA, the suit states.

Bennett seeks damages for past and future medical bills, pain and suffering, attorney fees and other compensation. He is represented by attorneys M. Shane Thompson and Scott G. Hunzicker of the Voss Law Firm in The Woodlands.
