Patient charges pump manufacturer with negligence

A Galveston County man has sued a medical device company alleging medical negligence due to a malfunctioning medication pump.

Ronnie Morgan filed a suit against Dallas manufacturer Medtronic PS Medical Inc. in Galveston County District Court on Jan. 9.

According to the complaint, prior to October 2013, Morgan had a Medtronic intrathecal pump implanted for the purpose of distributing morphine. On Oct. 16, 2013, he was admitted to Clear Lake Regional Medical Center, the suit states, where it was discovered that the pump was malfunctioning and the patient had consequently encountered morphine withdrawal symptoms.

Morgan had the pump surgically removed and replaced, according to the suit.

Morgan alleges: negligence in the original placement of the device without an adequate system in place to notify him of medication having run out; product liability owing to possible design and/or manufacturing defects; and breach of warranty.

Morgan seeks between $200,000 and $1 million for physical and mental anguish, loss of earning capacity, and court costs. He is represented by attorneys Michael R. McGown of Benckenstein, Norvell & Nathan in Beaumont, and Barry C. Bennett of Bennett Legal in Beaumont.
