Couple accuses home builder of financing fraud

A Harris County couple filed suit against a builder, alleging fraud and deception involving the financing of a home building project.

Scott Conkling and Melissa Conkling filed a lawsuit Feb. 5 against Blu Shields Construction of Texas City in Galveston County District Court.

According to the complaint, BSC owner Arnold “Blu” Shields met the Conklings in 2009 and offered them a contact to help finance new home construction but the contact was unable to provide financing and the project was put on hold. The plaintiffs approached Shields in an effort to move forward, paying a $35,000 deposit around July 3, 2014, the suit states, and were told the deposit was refundable.

The suit says the bank financing the project advised the Conklings in October 2014 that Shields had declared bankruptcy. They sent a written request for the return of their deposit but BSC failed to return it, the suit states.

The Conklings charge fraud, unfair business practices and wrongful conduct.

They seek damages between $100,000 and $200,000 plus the $35,000 deposit, damages and attorney fees. The Conklings are represented by attorney Richard A. Simmons of Waldron & Schneider in Houston.
