A Galveston County resident sued the Texas Department of Transportation for alleged negligence.
Robert Monych filed a lawsuit Feb. 5 the Galveston Division of the Southern District of Texas against the state Department of Transportation.
According to the complaint, Monych was sitting in his car aboard a ferry vessel owned and operated by the defendant between Galveston and Port Bolivar on Feb. 9, 2013, when the ferry caused him bodily injury when it collided with a pylon.
The operator and/or crew failed to control the boat’s speed and operate it safely to avoid the collision, the suit states, leading to Monych's injuries that arose from defective motor-driven equipment. Monych alleges he suffered impairment and loss of earning capacity.
Monych requests a citation on the defendant and seeks $100,000 in damages, medical expenses, attorney fees, expenses and costs. He is represented by attorneys Ryan Grant and Jesus Davila of the Grant Law Firm in Houston.
