Homeowner alleges unfair settlement

A Galveston County resident sued her insurance firm and several associated entities, alleging breach of policy.

Rachel Hammond filed a lawsuit Jan. 8 in Galveston County District Court against: Underwriters at Lloyd’s, London (ULL); Synergy Adjusting Corporation Inc., Georgia; TAPCO Underwriters Inc. of Texas; and David Colley of Houston, alleging negligence in the handling and settlement of a homeowner’s claim.

According to the complaint, Hammond owns insured property at 5009 Post Oak Lane, Texas City, and a hail or windstorm damaged the roof of her home April 2, 2013, causing water damage through walls, ceilings, insulation and flooring.

The suit says Hammond filed a claim with ULL and was assigned Colley of TAPCO. She alleges Colley’s investigation was inadequate, leading to denial of her claim, and the purported mishandling delayed her ability to repair her home, resulting in additional damage.

Hammond seeks compensation for treble damages, attorney fees, expenses and costs. She is represented by attorney Michael Ramsey of the Mostyn Law Firm in Beaumont.
