Dow employee claims negligence led to chemical exposure

A Galveston County man sued Dow Chemical Company, alleging negligence when he suffered chemical exposure.

Nazario Escudero filed a lawsuit Feb. 16 in Galveston County District Court against Dow Chemical Company, alleging injuries as a result of safety issues.

According to the complaint, Escudero was employed by Dow in Brazoria County on July 25, 2014, when a pipe leaked on him, exposing Escudero to the chemical epichlorohydrin and causing burns and respiratory issues. The suit states Dow failed to maintain a safe working environment or warn Escudero of conditions of equipment on site.

Escudero alleges negligence, gross negligence and premises liability. Dow should have inspected the premises for defects, warned him of possible safety issues and protected him from the same, the suit states.

The plaintiff seeks: between $200,000 and $1 million as compensation for physical pain, distress, and medical costs; damages for past and future loss of earning capacity, impairment and disfigurement; attorney and expert witness fees; court expenses; and costs. He is represented by attorneys Michael Pierce and Sofia Bruera of Pierce Chapman Skrabanek Bruera in Houston.
