A Tarrant County industrial firm has sued a Galveston County man, alleging breach of contract.
Conner Industries Inc. of Fort Worth filed a lawsuit March 19 in Galveston County District Court and seeks a restraining order against Steve Black of Kemah, citing a confidentiality issue.
According to the complaint, on Jan. 12, 2004, Conner Industries, which provides industrial lumber, wooden packaging and crating, hired Black as a salesman. Black resigned from his position Jan. 23 without the customary two weeks’ notice, the suit states, and immediately signed on with one of Conner’s competitors, Smith Companies.
Conner alleges Black used his Conner customer base on behalf of his new employer. It sent Black a cease and desist letter Jan. 29, and contends that Black has not complied. Conner charges breach of contract and fiduciary duty, alleging Black solicited at least five of its clients.
The plaintiff seeks an application for a temporary restraining order and both temporary and permanent injunctions against the defendant, actions that would mandate Black’s refraining from disclosing as well as returning confidential information.
Conner Industries requests compensation for exemplary damages, pre- and post-judgment interest, attorney fees, expenses and costs. The business is represented by attorneys Thomas S. Brandon Jr. and Rebecca Eaton of Whitaker, Chalk, Swindle & Sawyer in Fort Worth.
