Customer cites auto service center in accident

Car horn honking

A Jefferson County man has sued an auto service center, its owner and an employee, alleging negligence in a 2014 incident.

Mark Anthony Petry Sr. of Port Arthur filed a lawsuit March 16 in Jefferson County District Court, against Milton's Lube and Inspection Center, Steven Dale Killian and Blake Anthony Strayhorn, alleging damages from an accident on the defendant’s premises.

According to the complaint, on April 8, 2014, Petry's car was being serviced at Milton’s Lube and Inspection Center in Nederland, when Strayhorn backed up a vehicle, striking the plaintiff. Petry alleges severe injuries to his head, neck, back, left shoulder, left elbow, wrist and hand, left leg and knee, and his general body.

The suit says the defendants failed to maintain a proper lookout, control the vehicle in question, apply the brakes in a timely fashion, and navigate the vehicle attentively. The grievance also cites negligent entrustment of the vehicle. The complaint states Petry has suffered damages from loss of earnings and loss of earning capacity as a result of the accident.

The plaintiff cites mental anguish, pain, suffering and disability.

Petry seeks: compensation for medical expenses; pre- and post-judgment interest; attorney fees; expenses and costs. He is represented by attorneys James Payne, Jennifer Job and Ronnie Turner Jr. of Provost Umphrey Law Firm in Beaumont.
