Chicken worker cites Tyson in accident

A Louisiana man has sued Tyson Foods, citing injuries incurred in January.

Darius Hines of Mansfield, La., filed a lawsuit March 27 in the Marshall Division of the Eastern District of Texas against Tyson Foods Inc., alleging work-related injuries.

According to the complaint, Hines, employed by Tyson as a line worker, had been working for the company for about six months when on Jan. 1, he was asked to unlatch chicken cages secured to a flatbed trailer at Tyson's chicken processing plant in Center, Texas. The suit says he was not instructed or trained in the task, and on Jan. 7, a bar struck Hines’ right cheek and eye socket area.

According to the suit, Hines was given a bandage and sent home, but elected to go to the emergency room where he was diagnosed with severe facial trauma, and later required surgery and tooth extraction. The suit charges the defendant with negligence, alleging it failed to provide a safe workplace, proper training and supervision.

The plaintiff cites pain and suffering.

Hines seeks compensation in excess of $75,000 for past and future medical expenses, lost earnings, mental anguish, physical impairment and pre- and post-judgment interest, plus attorney fees, expenses and costs. He is represented by attorney Josh Maness of Waskom.
