A Tyler County man brought suit against a major oil company and affiliated firms claiming injuries in a 2013 incident.
Jimmie Solomon of Woodville filed against ExxonMobil Corporation of Austin, Clean Harbors Industrial Services Inc. and Clean Harbors Environmental Services Inc. of Dallas in Jefferson County District Court March 25, claiming negligence in a workplace accident in Jefferson County in April 2013.
The plaintiff alleges injuries due to the explosion and flash fire in the ExxonMobil Refinery Complex on or about April 17, 2013, which critically injured at least a dozen workers, according to court documents.
Solomon claims he has waited for two years for litigation of his case. He alleges misrepresentation, negligence and gross negligence on the part of the defendant, citing traumatic physical and emotional injury and disfigurement.
The complaint cites the defendants with allowing an unsafe condition; misrepresenting the work site as safe; failing to warn of hazard, maintain an adequate number of trained and supervised personnel to alleviate the incident; and failing to properly inspect, maintain, test and upkeep the premises.
Citing pain, suffering and disability, the plaintiff seeks: injunctive relief; compensation for medical expenses; actual damages; pre- and post-judgment interest; attorney’s fees; expenses, and costs.
