A department store customer brought a lawsuit against a major retail outfit for alleged grounds of negligence in a 2015 matter.
Kristy Campbell of Henderson filed against Dillard’s Department Stores Inc., headquartered in Little Rock, Ark., with offices in Dallas, in the Marshall Division of the Eastern District of Texas April 1, claiming injuries incurred on store premises.
According to the complaint, Dillard’s draped a display table with a cloth that extended to the floor and was accessible to bypassers browsing the merchandise exhibit in their Tyler location. Campbell’s feet became entangled in the cloth when she walked around the display on or about March 13, 2015 and she fell to the floor, the suit states.
Alleging a broken kneecap, the plaintiff cites the defendant with several counts of negligence, claiming the business failed to inspect its premises and arrange its displays safely; monitor and limit the length of table coverings to avoid their overflowing to the floor; and supervise its employees as to customer safety.
Citing pain and suffering, mental anguish, impairment and disability, disfigurement, and lost earnings, Campbell seeks: compensation in excess of $75,000 for medical expenses and damages; attorney’s fees; expenses, and costs.
