A Jefferson County business is suing a company for alleged breach of contract in an undated business services agreement.

EcoWater Industries LLC, doing business as EcoWerks, filed a lawsuit against S and D 360 Extreme Construction of Vidor on April 13 in Jefferson County District Court, alleging breach of contract.

Having entered into a contractual agreement for construction work at the plaintiff’s facility involving pouring concrete, the parties disagree as to the outcome. EcoWater claims that S and D failed to perform the work adequately, alleging the results to be useless and defective.

Specifically, the plaintiff asserts that the concrete surface has chipped and cracked in several areas, and that the defendant did not prepare a proper foundation or render the work waterproof as required by the job specifications.

EcoWater claims it not only must replace the defendant’s work, but also has sustained damages in the form of lost profits and revenue as a result of allegedly being unable to use the facilities as intended.

The plaintiff seeks: compensation in the amount of $500,000 to $1 million for actual and consequential damages; declaratory relief for its property; pre- and post-judgment interest; attorney’s and expert witness fees; expenses; and costs.
