Injured shopper blames Home Depot for falling merchandise

A customer has sued Home Depot, alleging negligence in a 2014 store accident.

Manuel Reyes filed a complaint May 1 in the Houston Division of the Southern District of Texas against The Home Depot U.S.A. Inc., citing premises liability and negligence.

According to the complaint, on April 30 ,2014, Reyes was a patron of the defendant’s store, 1111 Fry Road in Katy, when he was injured by unstable shelf products. The suit states the plaintiff was placed at unreasonable risk of injury from products being negligently placed on shelves.

The suit says Home Depot employees failed to render assistance. Reyes’ grievance cites the defendants for failing to: properly maintain, repair and inspect the premises; provide a safe and secure shopping environment; warn the plaintiff of the danger, or take preventive measures to avoid the accident, such as posting signage or altering the display.

The plaintiff cites physical pain and suffering, mental anguish, medical expenses, loss of earnings, disfigurement and permanent impairment.

Reyes seeks: compensation in excess of the minimum jurisdictional limits; exemplary damages; pre- and post-judgment interest; attorney fees; expenses and costs.
