A Colorado-based collections firm brought a lawsuit against a Jefferson County individual for alleged breach of fiduciary duty in an unresolved 2012 matter.
Cach LLC filed a petition against Ricky Bolyard of Port Neches in Jefferson County District Court on May 7 regarding a monetary dispute from June 2012.
According to the filing, GE Money Retail Bank issued a credit card in the defendant’s name. Bolyard allegedly accepted, received and used the card from the issuer, thus becoming obligated to pay for charges incurred on the account. When he purportedly defaulted on his monthly payments, the card was subsequently cancelled on or about June 20, 2012, with a balance due of $4,094.37.
The plaintiff alleges that no payments have been remitted, that it has demanded payment from the defendant with no results, and that it has performed all necessary obligations in the filing.
Citing breach of contract, the plaintiff seeks compensation in the exact amount of $4,094.37, post-judgment interest, attorney’s fees, expenses, all court costs and any other relief to which the plaintiff may be entitled as deemed appropriate by the court.
