A man who's back was broken when hit while at work is suing the man who hit him and his company for its own alleged role in the incident.

Billy Malloy Jr. filed a petition on May 12 in Galveston County District Court against Timothy Chason and Easy Does it Moving Co.

Malloy was a worker for the defendant, and on April 20. While working, he was injured seriously when defendant Chason hit him, the lawsuit states, and knocked him to the ground.

Malloy suffered serious bodily injuries, which included a broken back.

The plaintiff cites the defendant business for negligence in not providing a safe working environment, in poor hiring and retention practices and in training.

He seeks a minimum of $1 million in relief, plus costs.

The plaintiff is represented by attorneys John Daspit, Robert Morse and Kiernan McAlpine in Houston.

Galveston County District Court case no. 15-CV-0478.
