A Humble man brought a lawsuit against a company for alleged acts of workplace discrimination in an undated series of incidents during his employment.
Wallace J. LeDay filed suit against Curtis Steel Corp. of Houston and Insperity of Diamond Bar, Calif., in the Houston Division of the Southern District of Texas on May 15, citing racial discrimination and retaliatory termination.
LeDay alleges multiple undated acts of discrimination over the course of 12 years as an employee, including disparate pay, false accusations, unfair distribution of overtime hours, denial of promotion, and wrongful termination. He cites management staff’s lack of attention to a purportedly hostile work environment that tolerated nepotism and bias.
The plaintiff filed a complaint with the EEOC. The EEOC had initially dismissed the case on Jan. 29, when more than 180 days had elapsed since the initial filing; LeDay then received a notice of intent to reconsider from an EEOC district director in Austin filed on Feb. 13, 2015; and received notice of the right to sue on Feb. 18, 2015. The adjustment was based on a previous technical error, the suit states.
The plaintiff seeks reinstatement and reimbursement of benefits equal to that of Caucasian co-workers, along with back pay.
