Orange resident sues Travelers for hurricane claim

Orange County resident Rex Mccorqodale has filed a lawsuit against Travelers Lloyds of Texas Insurance Co. for refusing to pay his claim in full following Hurricane Rita.

According to Mccorqodale's petition, which was filed with the Orange County District Court on April 18, the plaintiff was contracted with Travelers. His policy covered the damage to his home and additional living expenses.

After Rita hit, his home became uninhabitable, suffering extreme water damage. Mccorqodale submitted a claim for living expenses and repair costs. He is claiming he did not receive the full amount of his claim, the suit said.

His suing for the remainder of the unpaid claim, mental anguish and court costs. He is asking for nearly $40,000 in all.

Mccorqodale claims Travelers violated the Texas Insurance Code by not responding to his claim in 15 days, breached its contract, and is guilty of deceptive trade practices.

"Travelers failed to attempt to (offer) a prompt, fair and equitable settlement of claim," the suit said.

He is represented by the law firm Clay Douglas and Associates.

The case has been assigned to the 128th Judicial District.
