Michael and Audrey Louviere vs. Allstate Lloyds et al

Following Hurricane Rita, homeowners Michael and Audrey Louviere filed a claim with their insurer Allstate. Now the company has filed another claim, this one for damages in civil court after they say Allstate did not fulfill its contract.

The Louvieres filed a civil suit in Orange County District Court on July 24.

The couple says the 2005 hurricane damaged their home on Sudduth in Bridge City and submitted a claim to Allstate for roof, water, wind, foundation and structural damage.

"Plaintiffs asked for repairs to property pursuant to the policy and for additional living expenses," the plaintiffs' original petition states.

After receiving the claim, Allstate sent a total of six different adjusters to evaluate the Louviere's residence. The homeowners say the insurance company later refused to pay the full proceeds they were due under the policy.

Carl McFarlane vs. AMC Mortgage Services Inc. et al

It was bad enough that Hurricane Rita left Carl McFarlane's home unlivable, but the Orange County resident says on top of that his mortgage company had let his homeowners' insurance lapse.

McFarlane filed a lawsuit against AMC Mortgage Services Inc., Texas Farm Bureau Insurance and others in Orange County District Court on July 27.

McFarlane faults AMC Mortgage for failing to obtain proper insurance on the house even though it was required. Texas Farm Bureau Insurance, Tracksure Insurance Agency and others are also guilty, the plaintiff alleges, for "allowing the insurance to lapse even though proper payment was made."

O.D. Simpson Sr. vs. Allstate Lloyds et al

Like many other residents in Southeast Texas, O.D. Simpson Sr. of Orange sustained damage to his home from Hurricane Rita in 2005. And like many others, he is filing a lawsuit against his insurer Allstate for wrongfully denying his claim.

According to the plaintiff's original petition, the hurricane damaged Simpson's home on Blyley Boulevard in Orange and he submitted a claim to Allstate for roof, water, wind, foundation and structural damage.

After receiving the claim, Allstate sent a total of four different adjusters to evaluate the Louviere's residence. The homeowners say the insurance company later refused to pay the full proceeds they were due under the policy.

"Allstate wrongfully denied plaintiffs' claim for repairs to property, even though the policy provided coverage for losses such as those suffered by plaintiffs," the suit alleges.
