Dragon Products, Ltd. has filed a lawsuit against TXD Transport, claiming TXD purchased $1.3 million worth of equipment but never paid the bill.
Dragon Products filed its breach of contract lawsuit with the Jefferson County District Court on Sept. 14.
According to the Dragon Product's Web site, the business is a group of companies that consists of Dragon Products, Dragon Rigs Sales and Service, Dragon Centrifugal Pumps Sales and Service, Tiger Offshore Rentals, Tiger Industrial Rentals, Tiger Safety, Modern Ag Products and MG Finance.
According to the plaintiff's original petition, TXD purchased 26 BBL tank trailers and five frac tanks from Dragon. $1,311,280 was charged to TXD's open account, "which has been overdue since January 2007.
"Defendant has failed and refused to pay all amounts owed under the account," the suit said, adding that after the purchase, Dragon delivered the goods but never received full payment.
Dragon is suing for the unpaid balance on the account, interest, consequential damages and attorney's fees.
Dragon is represented by Orgain Bell & Tucker attorney John Seth Bullard.
"John Seth's practice is dedicated primarily to labor and employment litigation. He also provides consultation to employers on labor and employment law issues," the firm's Web site said. "In addition to his labor and employment law practice, John Seth handles cases that involve personal injury, insurance coverage, debt collections, and general business litigation.
Judge Donald Floyd, 172nd Judicial District, will preside over the case.
