Bridge City woman files nuisance suit against contractors

With the Lone Star State's population on the rise, most Texans have experienced some type of a construction-related nuisance that always follows growth.

When Leah Johansson came home and found her driveway cluttered with construction trucks and workers who were shouting obscenities at her, she filed suit against, Boren Dry Wall, a property development company, and the city of Bridge City.

Johansson filed her claim for nuisance lawsuit with the Orange County District Court on Sept. 18.

According to the plaintiff's original petition, Johansson operates a business out of her home, which requires her tenants and employees to have access to her property.

Barry Boren and his development companies own property across the street from Johansson and are currently "developing a residential subdivision (entitled) Prairie View Addition Phase II," the suit said.

She claims the construction project has "caused damage to her property and has limited her use and enjoyment of her property," the suit said.

Johansson's claims for nuisance against the defendants include workers using and blocking her driveway, workers parking on the street, severing the flow of electricity to her property, and "congregating on Plaintiff's property and calling her obscene names when she would come outside," the suit said.

In her suit, Johansson also alleges the following acts of negligence, workers spray painting her lawn, workers parking on her lawn, workers knocking down her mailbox and workers failing to cover up a drainage hole, which she tripped and fell in.

Furthermore, she claims the defendants committed fraud by connecting the residential project's sewer line to her private sewer line.

Johansson is suing for past and future physical pain, mental anguish, medical expenses, plus damages for the repair of her property.

She is demanding a trial by jury and is represented by attorney John R. Dolezal.

The case has been assigned to the 128th Judicial District.
