Smacked in the face by a free-swinging pipe, Timothy Fregia, a pipe welder, claims Dependable Lease Services and Samson Lone Star LLC failed to control the job site and negligently caused him injury.
Fregia has filed suit against both companies. His suit was filed in the Jefferson County District Court on Feb. 22.
According to the plaintiff's petition, on April 4, 2007, Fregia was working as a welder on the McClintock gas well and pipeline owned by Samson, when employees of Dependable Lease caused a six-inch pipe and flange to strike and injure him.
"Plaintiff's injury and resulting damages were proximately caused by the negligence of Defendants in failing to maintain a safe work place and by utilizing an unsafe work procedure and faulty equipment," the suit said.
The suit does not give any more information on how Fregia's injury occurred or how badly he was hurt.
Fregia is suing for past and future medical expenses, mental anguish, pain, impairment and loss of earning capacity.
He is represented by attorney Mike Morris of the Tekell, Book, Matthews & Limmer law firm.
Judge Milton Shuffield, 136th Judicial District, has been assigned to the case.
