April 16

  • Glenn E. Grogan vs. Wilbert Richard

    PA � Mel Shelander, J � Donald Floyd
    Grogan is suing Richard for $6,045 for labor he performed on his property, located at 2280 Hegele, Beaumont. Grogan says he furnished the materials for the job and completed the improvements on Jan. 18, 2008. The plaintiff is also suing for $5,000 in attorneys' fees.

  • Bare Burn Construction Co. vs. Nevco Waterproofing, Inc.

    On Aug. 30, Nevco entered into a subcontract with Bare Burn for work on a piece of property. Sometime later, the owners made a claim against Bare Burn for property damages. Bare Burn alleges the damages are a result of the work Nevco performed and is suing the company for actual damages, plus all court costs.

  • Troy Wagner vs. Performance Radiator of Houston Inc. et al

    On Feb. 13, 2008, Wagner was driving his motorcycle when a PRH truck driver, Angelique Griffith, made an improper lane change and struck him. Thomas says he suffered permanent injuries to his neck and back in the incident. The suit does not state where the incident occurred.

    The plaintiff is suing for past and future medical expenses, pain, impairment, loss of earnings, loss of consortium, loss of household services, disfigurement and mental anguish, plus actual and consequential damages.

  • Louise Thibodeaux vs. Chevron USA Inc. and Texaco

    The widow of a former refinery worker has filed suit against Chevron USA and Texaco, claiming the oil companies negligently and maliciously exposed her late husband to asbestos. The plaintiff is suing for exemplary damages.

  • Mary Clanan vs. Chevron USA Inc.

    The widow of a former carpenter has filed suit against Chevron USA, claiming the oil company negligently and maliciously exposed her late husband to asbestos. Mary Clanan filed her suit on behalf of William Clanan. She is suing for exemplary damages.

  • Genie Constance et al vs. Countrywide Home Loans

    The plaintiff is suing Countrywide for attempting to collect back payments and late fees on her mortgage. The plaintiff entered into a forbearance program to suspend her mortgage payments after Hurricane Rita devastated Southeast Texas.

    On Feb. 20, 2007, the plaintiff was involved in an automobile collision with the defendant. Ford alleges Thomas negligently failed to control his rate of speed, keep a proper lookout and apply his brakes. The suit does not state where the incident occurred. The plaintiff is suing for past and future medical expenses, pain, impairment, loss of earnings, disfigurement and mental anguish, plus all court costs.

  • Sharon Nails vs. Joseph W. Outlaw

    On Oct. 20, 2007, Nails was operating her vehicle in a prudent manner when she "violently collided with" Outlaw. The plaintiff alleges the defendant negligently failed to control his rate of speed, keep a proper lookout and apply his brakes. The suit does not state where the incident occurred.

    The plaintiff is suing for past and future medical expenses, pain, impairment, loss of earnings, disfigurement and mental anguish, plus all court costs.

  • Chad and Lori LaBove vs. Lamar Advertising

    Apparently, not only can you "not turn off Lamar Advertising's billboards as you drive away," but you also can't get them off your property once it erects a billboard. The owners of Daviss Donuts, Chad and Lori LaBove, have filed suit against Lamar Advertising, claiming the company erected a billboard on their property without permission and refuses to tear it down.

    The LaBoves claim Lamar Advertising has illegally and improperly appropriated land belonging to them and are seeking recovery of the reasonable value of the use of this portion of land, as well as loss of usable parking space caused by the sign's placement.

  • Ena H. Davis vs. Concord Manor Apartments

    An exploding stovetop splashed scalding hot water all over Ena H. Davis's face. Davis claims her three minor children, who witnessed the incident, were traumatized. Alleging the apartment complex she lives in was responsible for the stove's faulty condition, Davis filed suit against Concord Manor Apartments.

    Davis is suing for past and future medical expenses, impairment, disfigurement and mental anguish. She is also suing for mental anguish on behalf of her children.

  • Doguet's Rice Milling vs. Gulf Rice Milling

    Doguet's Rice Milling has filed suit against Gulf Rice Milling in hopes of recovering more than $200,000 on an unpaid account. Doguet's claims Gulf Rice owes it $237,960. The company is also suing for court costs and attorneys' fees.

  • Joyce Hervey vs. Ernest Antoine, Jr.

    On July 20, 2007, Hervey was operating her vehicle in a prudent manner when she "violently collided with" a vehicle operated by Antoine. The plaintiff alleges the defendant negligently failed to control his rate of speed, keep a proper lookout and apply his brakes. The suit does not state where the incident occurred.

    The plaintiff is suing for past and future medical expenses, pain, impairment, loss of earnings, disfigurement and mental anguish, plus all court costs.

  • Carl Adams vs. Farmers insurance Exchange

    Adams is suing Farmers for allegedly denying at least a portion of his property damage claim. On June 4, 2007 a fire broke out on the plaintiff's property. Renick claims Farmers wrongfully denied him the full proceeds of his policy, even though Farmers is contractually obligated to pay the full claim.

  • Sandra Burrell vs. San Juan Fiberglass Pools et al

    Buddy and Stacy Hamilton are authorized dealers of San Juan Pools. On Feb. 20, 2000, the plaintiff entered into a contract with the Hamiltons for the purchase and installation of a San Juan pool. In 2007, the pool began flaking and cracking � a problem the plaintiff alleged San Juan and the Hamiltons were aware of but still chose to sell the pool to her.

    The plaintiff is suing the Hamiltons and San Juan under the DTPA.

  • Patsy Roberts vs. Boston Scientific Corp. et al

    Patsy Roberts, individually and on behalf of the estate of the deceased Joseph Roberts, filed a wrongful death suit against Boston Scientific and Guidant. She claims her husband received an implantable cardiac defibrillator that was defective and unreasonably dangerous. The suit alleges the defendants committed negligence, fraud, breach of warranty and violated the Texas Deceptive Trade Practices Act.

    The plaintiff is seeking damages for Joseph Roberts pain, suffering and mental anguish, loss of consortium, bereavement, medical and burial expenses, attorneys' fees, interest and costs in addition to exemplary damages.

  • R.J. Wortham, Jr. vs. Golden Triangle Cycle Center

    J � Chris Portner, J � Bob Wortham

    Nearly two years ago, R.J. Wortham, Jr. purchased a new jet ski from Golden Triangle Cycle Center. When his new toy sputtered out on him, Wortham brought it back for repairs, along with another allegedly defective jet ski.

    Wortham is suing for actual damages and attorneys' fees.

  • Ruston Benoit et al vs. Valero Energy et al

    PA � John Werner, J � Donald Floyd

    Beaumont's own Reaud, Morgan & Quinn law firm launched a new class action against Valero Energy on April 18, alleging the oil giant circumvented paying its contactors overtime by classifying workers' wages as "per diem." The suit was filed on behalf of class representative Ruston Benoit. The class is suing for past overtime and attorneys' fees.

  • Denfred Brown vs. Mark P. Conroy

    On May 5, 2005, Brown was traveling on I-10 when he collided with Conroy. The plaintiff alleges the defendant negligently failed to control his rate of speed, keep a proper lookout and apply his brakes.

    The plaintiff is suing for past and future medical expenses, pain, impairment, loss of earnings, disfigurement and mental anguish, plus all court costs.

  • C.H. et al vs. estate of Leslie Jennings

    PA - Michael Lindsay, J - Milton Shuffield

    The parents of minor child, who was spending the night at a friend's house when the father went on a "shooting rampage," have filed suit against the estate of Leslie Jennings.

    Leslie Jennings and two of her children were murdered by Richard Jennings on June 30, 2006. The parents -- identified only as C.H. and M.H. -- claim Leslie should "have known of Richard's propensity for violence."

    An article in the Beaumont Enterprise reported that in the early morning of June 30, Richard shot and killed his wife and two of three children before turning the weapon on himself. His 13-year-old son escaped and went to get help.

  • Yolanda Sandria Saqui et al vs. Pride International Inc.

    In anticipation of a hurricane, a Mexican seaman attempted to remove the jack-up rig's flare stack, but the chain linking the flare stack recoiled, thrusting the man of the rig and into the Gulf of Mexico, where he drowned.

    The incident happened almost four years ago and now the Mexico-based family of the late Miguel Sandria has filed suit against his employers in Jefferson County. The suit, filed on April 21, names Pride Central America, Mexico Drilling Limited and Gulf Personnel Services as defendants. Sandria's mother, Yolanda Sandria, is the lead plaintiff.

  • Helen Duhon et al vs. Henry LaRocca

    Only weeks before Christmas 2006, Henry LaRocca ran over his wife Brenda with a pickup truck while backing out of his West End home's driveway, leaving the couples' five children motherless. On April 22, the LaRocca children's grandparents, Helen and Fritz Duhon, filed suit against Henry, seeking to recover survival damages.

  • Christopher and Jacqueline Bertrand vs. EI DuPont De Nemours

    PA � Jason Itkin, J- Bob Wortham

    A pair of chemical emissions detectors are suing EI DuPont De Nemours for exposing them to chemicals while on the job. Christopher and Jacqueline Bertrand, employees of METCO Non-Destructive Testing Co., also claim they suffered "orthopedic injuries while escaping the toxic DuPont plant."

    The Bertrands are suing for past and future medical expenses, mental anguish and loss of consortium, plus compensatory and actual damages.
