Contractor sues to collect balance of repair bill

A local building contractor has filed suit against the owner of a Port Arthur business complex to collect an outstanding balance for improvement work.

Marsh Waterproofing Inc., a company based in Vidor, filed a contract suit against 2901 Turtle Creek Ltd. on April 28 in Jefferson County District Court.

According to the plaintiff's original petition, Marsh provided labor and materials to improve the property on Turtle Creek Drive in Port Arthur during the months of September 2007 and January 2008.

The plaintiff states that the scope of work included cleaning of exterior surfaces, tuck pointing of mortar joints, caulking and wet glazing of window and door frames, recaulking control joints and steel lintels, redesigning weep holes over all windows, painting decorative steel and lintels and applying transparent water repellant to bricks.

An invoice attached to the complaint shows that the project totaled $79,000 and that the defendant has paid $67,150. Marsh filed the complaint to collect $11,850 it claims has remained unpaid.

Bill Richey of Griffin & Matthews in Beaumont is representing the plaintiff.

The case has been assigned to Judge Bob Wortham.
