This Just In: Recent civil suits filed in Jefferson County District Courts

July 30

  • Joyce and Naomi Bellard vs. Empire Indemnity Insurance Co. et al

    PA – Steve Mostyn, J – Donald Floyd

    The plaintiffs are suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of their Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations.

    The plaintiffs are suing for actual and consequential damages, plus attorneys' fees.

  • Arhonda Eugene vs. Capitol County Mutual Fire Insurance Co. et al

  • Paula Schooley vs. Marcus and Raynell Lewis

    PA – Brain Sutton, J – Milton Shuffield

    On May 10 the plaintiff was operating her vehicle somewhere in Jefferson County when she was hit by Marcus. The vehicle was owned by Raynell. The suit gives no details about the collision.

    The plaintiff faults Marcus for allegedly negligently failing to keep a proper lookout and heed traffic control devices, and further faults Raynell with negligent entrustment.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost wages and impairment, plus actual damages and court costs.

  • Lothell Gibson et al vs. Steve Bryan et al

    PA – Mark Sparks, J – Gary Sanderson

    A pair of local residents have filed suit against several contractors who were hired to repair their home's roof. Lothell Gibson and Stephanie Norman filed their suit against contractors Steve Bryan (Bryan Construction) and Bobby Boling Jr. (Texas Roofing Authorities).

    The plaintiffs claim the defendants are guilty of violating the Texas Deceptive Trade Practices Act, and are suing them for punitive, actual and economic damages, plus all court costs.

  • Charisee Buxie vs. H-E-B

    PA - Matthew Matheny, J - Gary Sanderson

    Beaumont resident Buxie is claiming she was hit by a car while strolling through an H-E-B parking lot.

    Alleging the H-E-B on 11th Street negligently failed to post warning signs in its parking lot, Charisee Buxie filed suit against the grocery store.

    Buxie is suing for exemplary damages, plus past and future mental anguish, lost earnings, disfigurement, impairment, medical expenses and loss of household services.

  • ICO Polymers North America vs. Toyotalift of Houston

    PA – David Starnes, J – Gary Sanderson

    Throughout 2004 and 2005, ICO Polymers North America purchased several forklifts from Toyotalift of Houston. When the forklifts were in need of repair, Toyota allegedly refused to fix them, "but took ICO's money for them anyway."

    Seeking to recover actual and economic damages, ICO filed a breach of contract against Toyotalift.
