This Just In: Recent civil suits filed in Orange County District Courts

Aug. 13

  • Terri Jones vs. GMC et al

    PA – Clay Dugas, J – Pat Clark

    Claiming she was sold a lemon, Terri Jones has filed suit against Harmon Chevrolet and General Motors Corp.

    In her suit, Jones' says she purchased a Chevy Equinox from Harmon Chevrolet on Aug. 18, 2006. During the first year of ownership, the vehicle's ignition switch allegedly malfunctioned on several occasions. She is suing for economic damages and attorneys' fees.

  • Ronald Peveto vs. Allstate

    PA – Sandee Hart, J – Pat Clark

    The plaintiff was in an automobile collision with an "under-insured" motorist and claims he suffered in excess of $25,000 in damages.

    Wanting more money then the $25,000 cap on his policy, the plaintiff is suing Allstate for Treble damages and attorneys' fees. The suit does not say when the plaintiff was injured.

    Aug. 15

    Veronica Sams vs. State Farm Lloyds et al

    PA – Steve Mostyn, J – Buddy Hahn

    The plaintiff is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Rita damage claim.

    The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Joe F. Smith, Sr. vs. James and Johnnie Lawson

    PA - Jerry Pennington, J- Dennis Powell

    Uninvited guests tax most people's patience. Guests who decide to park their trailer on someone else's property without permission would probably try everyone's patience.

    In hopes of retaking his property, Billy Joe F. Smith, Sr. has filed suit against James and Johnnie Lawson, claiming the couple unlawfully entered his property and parked their trailer next to a house owned by him.

    Smith is asking the court award him title and possession of the property, actual damages and attorneys' fees.

  • Jennifer Scarborough Signal International of Texas

    PA – John Morgan, J – Dennis Powell

    Shortly after being fired by Signal International of Texas, Jennifer
    Scarborough filed suit against the company, claiming she was sexually harassed and discriminated against. She alleged her firing was gender motivated and is suing for punitive damages.

  • Ladonna Cezar vs. Farmers Insurance Exchange et al

    PA – Christopher Smith, J – Buddy Hahn

    The plaintiff alleges Farmers and its agents and subsidiaries failed to adequately compensate her under her policy after her home flooded on Sept. 5, 2006, due to a leaky toilet. She is suing for actual and consequential damages.

  • Joseph and Mary Sias vs. Capitol County Mutual Fire Insurance Co. et al

  • Edna Gibson et al vs. E.I. DuPont De Nermours et al

    PA – Darren Brown, J – Dennis Powell

    The family of a deceased E.I. DuPont De Nermours employee has filed suit against the chemical company and 43 other businesses, claiming he was exposed to benzene during his career.

    Gibson's family is suing for his mental anguish, pain, disfigurement and lost wages, on top of punitive damages.
