This Just In: Recent civil suits filed in Jefferson County District Courts

Aug. 29

  • Irene Louis vs. Fire Insurance Exchange et al

    PA – Steve Mostyn, J – Bob Wortham

    The plaintiff is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Susan and Ronald Page vs. Peter Gray et al

    PA – Brett Thomas, J – Bob Wortham

    Susan Page is suing Peter Gray for an automobile collision that occurred Sept. 6, 2006, in the 1500 block of Cardinal Drive. Gray's vehicle had mechanical problems and he was forced to stop in the middle of a lane. Page stopped behind him and was rear-ended twice by defendants Latonya McDaniel and Randall Vaughn.

    McDaniel and Vaughn are also named as defendants.

    The plaintiffs are suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Dominica Garza vs. Thanh Nguyen

    PA – Thomas Henry, J – Gary Sanderson

    On Nov. 25, 2007, the plaintiff was traveling in eastbound on I-10 in Louisiana when her vehicle was struck from behind by the defendant. The suit says jurisdiction is proper in Jefferson County because the defendant resides in the country.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Warren Bellain vs. John Wagner

    PA – John Carwile, J – Gary Sanderson

    On Nov. 21, 2006, the plaintiff was injured as a result of a collision at Highway 69 when the defendant collided with his vehicle. The suit does not detail how the incident occurred.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Charles Freeman vs. Dustin Hoffpauir

    PA – Bob Monk, J – Donald Floyd

    On May 5, 2007, the plaintiff was traveling westbound on East Lucas when the defendant changed lanes and hit his vehicle.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Joan Roberts vs. Carl Perricone III

    PA – Douglas Sikes, J – Bob Wortham

    On Aug. 17, 2007, the defendant was traveling east on 7th Avenue when failed to yield at a stop sign and collided into the plaintiff's vehicle.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • The American Eagle Reserve vs. Justin O'Neal

    PA – Carl Parker, J – Donald Floyd

    The plaintiff is suing a former employee who allegedly stole the company's trade secrets and started his own business. The plaintiff is seeking an injunction to stop the defendant from contacting its customers.

  • Melvin Barry vs. Morgan Towing and James Wriston

    PA – Trent Bond, J – Gary Sanderson

    The plaintiff is suing Wriston, a Morgan Towing employee, for causing an automobile collision on July 7, 2008. The suit does not entail how the incident occurred and also says Morgan Towing was negligent for entrusting its vehicle to Wriston.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Kesha Lee vs. East Mount Olive Baptist Church, Inc. et al

    A Beaumont woman is suing a local church for an automobile collision that occurred more than two years ago.

    Lee is suing for past and future mental anguish, disfigurement impairment and medical expenses.

  • Vera Dugger vs. Dr. Mae Wesson

    PA - Tommy Hastings, J - Donald Floyd

    Around two years ago, Vera Dugger went in for cataract surgery. A week after the operation, she went blind in one eye.

    Now, Dugger is suing the surgeon who performed the operation, Dr. Mae Wesson.

    She is suing for past and future mental anguish, impairment, disfigurement, lost wages and medical expenses.

  • Dawn Dunn vs. Kaplan Inc.

    PA - Steve Parkhurst, J - Donald Floyd

    Claiming she was sexually harassed at a company Christmas Party, Dawn Dunn has filed a suit against her former employer, Kaplan Inc., which does business in the area as Texas Careers – Beaumont.

    Dunn alleges Kaplan made her working environment "intolerable" and is suing the company for past and future back pay, mental anguish and loss of enjoyment, plus exemplary damages and attorneys' fees.
