This Just In: Recent civil suits filed in Jefferson County District Courts

Oct. 7

Katie Fay Houston vs. James William Laird

PA – David Ferrell, J – Bob Wortham

On May 22, the defendant was in an automobile collision with the plaintiff. The suit does not state how the incident occurred. The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

Jamie Sue Preston vs. Jeff Felder

PA – Trenton Bond, J – Gary Sanderson

On Jan. 4, 2007, the defendant was in an automobile collision with the plaintiff. The suit does not state how the incident occurred.

The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

    On July 1 the plaintiff was traveling in the northbound lane of I-10 service road when the defendant allegedly ran a red light and collided with the plaintiff's vehicle.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Alicia Hufstetler vs. Graig Borel

    On July 31 the defendant was in an inflatable device floating along the Neches River when the defendant allegedly negligently failed to control his boat and ran over her as she lay in her tube.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

    S&S Sprinkler Co. vs. Firetrol Protection System, Rodney Sowell and James Hagan.

    PA – Bruce Partain, J – Gary Sanderson

    The plaintiff is suing Sowell and Hagan, two of its former employees, for allegedly stealing its trade secrets and teaming up with FPS.

    The plaintiff is asking the court to stop the defendants from utilizing its trade secrets and stealing its clients. The plaintiff is also suing for actual and consequential damages.

    On April 9 the plaintiff was traveling westbound on Highway 87 in Port Arthur when the defendant allegedly failed to control his rate of speed and rear-ended him.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

    On May 12, 2007, the plaintiff was traveling eastbound when Balderas continued to go straight from a turn lane only and hit her vehicle.

    On March 8, 2007, the plaintiff was traveling on Gulf Street when the defendant failed to yield the right-of-way while turning into a private drive.

  • Travis Talbert vs. Willis Turner and KWT Construction

    On Aug. 28, 2007, the plaintiff was on the defendant's premises for the purposes of making a bid when he stepped on loose board and fell around 10 feet.

    The plaintiff alleges the defendant allegedly negligently failed to inspect and maintain its property and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Kay Maxwell vs. Robert Brown

    On Dec. 28, 2006, the plaintiff was operating a vehicle on Spur 93 in Port Arthur when she was struck by the defendant, who allegedly failed to yield the right-of-way while entering the roadway.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Victor Gonzales vs. Allstate County Mutual Insurance Co.

    On July 13, 2007, the plaintiff was in an automobile collision with the defendant when the defendant allegedly failed to stop at a stop sign.

  • Perry and Brenda Breaux vs. Capitol County Mutual Fire Insurance Co. et al

    The plaintiffs are suing the insurance company and several of its adjusters for allegedly refusing to pay at least a portion of their Hurricane Rita damage claim. The suit alleges the defendant is guilty of Texas Insurance Code and DTPA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Denise Griffin vs. American Real Estate Corp. et al

    A Beaumont Enterprise papergirl is suing two property management companies and two local residents for tripping and falling down a flight of stairs while delivering the news.

    Denise Griffin filed suit against Maison Helena Townhomes Association, American Real Estate Corp., Melba DuPlantis and John Read, claiming the stairs she slipped on were negligently maintained.

  • Irene Palmer vs. Logan's Roadhouse

    PA - William Morian Jr., J - Gary Sanderson

    Minding her own business, Irene Palmer says she has casually enjoying her meal at Logan's Roadhouse on Dowlen when a waiter bumped her in the back with "a heavy table." Claiming she was injured as a result of the waiter's alleged negligence, Palmer filed suit a lawsuit against the restaurant.

    Palmer is suing for past and future medical expenses, pain, mental anguish and impairment, plus all court costs.

  • Mary Bourne vs. Wal-Mart

    PA - Gilbert T. Adams, J - Gary Sanderson

    On her way to the register, Mary Bourne slipped and fell when she stepped into a Wal-Mart hand-held shopping basket. She claims the basked "posed an unreasonable risk of harm" to her and is suing the mega retailer.

    She is suing for past and future medical expenses, pain, mental anguish and impairment, plus all court costs.
