This Just In: Recent civil suits filed in Orange County District Courts

  • Nelda Yancey vs. Home Depot

    PA - Jonathan Harris, J – Pat Clark

    A Home Depot employee is suing her employer for requiring her to lift merchandise. Nelda Yancey was moving a "heavy bundle" with a co-worker when the other worker "negligently lost control of the load."

    Yancey says she hurt her wrist when she "was required to lift too much without assistance."

    Yancey is suing for past and future mental anguish, lost earnings, impairment, disfigurement and medical expenses, plus exemplary damages.

  • Lois Rochester vs. A.W. Chesterton et al

    PA – Lou Black, J – Dennis Powell

    Representing the estate of Augustus Rochester, Lois Rochester has filed an asbestos suit against A.W. Chesterton and 55 other companies, claiming the corporate defendants maliciously inflicted her benefactor with an asbestos illness.

  • Renee Harvey et al vs. Larry LeDay

    PA – Charlton Hornsby, J – Buddy Hahn

    Harvey, along with Melissa and Seth Riley, are suing the defendant for allegedly causing an automobile collision on March 10.

    The Rileys were passengers in Harvey's vehicle. Harvey was traveling on 16th Street when the defendant allegedly ran a red light and struck her vehicle.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Shane Chouest vs. Inland Marine Management Corp. et al

    PA - Nanette J. Hartdegen, J – Dennis Powell

    A Louisiana seaman has filed a Jones Act suit against his employers, claiming the cables he was told to lift were too heavy and caused him injury.

    Chouest is suing for past and future mental anguish, lost earnings, impairment, disfigurement and medical expenses, plus court costs.

  • Kenneth and Holy Wilgers vs. Omni Energy Services and Lake Ronel Oil Co.

    PA – Tomas Moses, J – Buddy Hahn

    Starting in October 2007, the plaintiffs allege the defendants began trespassing on their Vidor property for the purposes of digging holes and detonating seismic charges in search of natural resources.

    The plaintiffs alleged the defendants' unwanted actions have damages their property and are suing for actual and consequential damages.

  • Marco Fuentes vs. Latex Construction Co.

    PA – Vuk Vujasinovic, J – Buddy Hahn

    The plaintiff has filed a Jones Act suit against the defendant for injuries he received while serving on a barge June 13. The suit gives no insight on how or where the plaintiff was injured.

    The plaintiff is suing for past and future mental anguish, lost earnings, impairment, disfigurement and medical expenses, plus court costs.
