This Just In: Recent civil suits filed in Jefferson County District Courts

Oct. 15

  • Perry and Brenda Breaux vs. Capitol County Mutual Fire Insurance Co. et al

    PA – Steve Mostyn, J – Donald Floyd

    The plaintiffs are suing the insurance company and several of its adjusters for allegedly refusing to pay at least a portion of their Hurricane Rita damage claim. The suit alleges the defendant is guilty of Texas Insurance Code and DTPA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Irene Palmer vs. Logan's Roadhouse

    PA - William Morian Jr., J - Gary Sanderson

    Minding her own business, Irene Palmer says she has casually enjoying her meal at Logan's Roadhouse on Dowlen when a waiter bumped her in the back with "a heavy table."

    Claiming she was injured as a result of the waiter's alleged negligence, Palmer filed suit a lawsuit against the restaurant.

    Palmer is suing for past and future medical expenses, pain, mental anguish and impairment, plus all court costs.

  • Mary Bourne vs. Wal-Mart

    PA - Gilbert T. Adams, J - Gary Sanderson

    On her way to the register, Mary Bourne slipped and fell when she stepped into a Wal-Mart hand-held shopping basket. She claims the basked "posed an unreasonable risk of harm" to her and is suing the mega retailer.

    She is suing for past and future medical expenses, pain, mental anguish and impairment, plus all court costs.

  • Doak Procter III vs. Island Wind Design & Construction

    PA – Stacie Augustine, J – Bob Wortham

    On April 8, the plaintiff hired the defendant to remove and replace siding and a concrete slab at his Crystal Beach cabin. During the process, one of the defendant's employees allegedly crushed two sewer lines and caused damage to his property.

    The plaintiff is alleging the defendant breached its contract and is guilty of deceptive trade practices. He is suing for exemplary damages and attorneys' fees.

  • Destiny Green et al vs. Wendell Frazier

    PA – Pro se, J – Gary Sanderson

    Representing herself and her minor daughter, the plaintiff is suing the defendant for allegedly causing an automobile collision May 19. The suit does not state how the incident occurred.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Jack Sanford vs. Joshua Richard

    PA – David LaRue, J – Milton Shuffield

    On March 30, 2007, the plaintiff was traveling east on Ave. A in Nederland in a school zone. When he stopped for a crossing guard, the plaintiff was rear-ended by the defendant, who allegedly failed to control his rate of speed.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Samdreika Thomas vs. Fred and Katharine Mayo

    PA – Charlton Hornsby, J – Bob Wortham

    On Oct. 11, 2007, the plaintiff was traveling north on US-69 in Nederland when she was rear-ended by Katherine. The suit also faults Fred for negligently entrusting his vehicle to Katharine.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Helen Bernard vs. Standard Guaranty Insurance Co.

    PA – Brandon Monk, J – Bob Wortham

    The plaintiff is suing the insurance company for allegedly refusing to pay her fire damage claim. The plaintiff's home was ravaged by fire Aug. 20, 2005.

    The defendant allegedly refused to pay her claim, even though it was contractually obligated to do so.

    The plaintiff is suing for actual and consequential damages, plus court costs.

  • Ashlee Pagan vs. Elizabeth Howard

    PA – Jon Burmeister, J – Gary Sanderson

    On March 31 the plaintiff was in an automobile collision with the defendant. The suit does not state how the incident occurred.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Willie and Beverly Yarbrough vs. Capitol County Mutual Fire Insurance Co. et al

  • Rodney LeJeune vs. A.O. Smith Corp. et al

    PA - Bryan Blevins, J - Donald Floyd

    Provost Umphrey attorney Bryan Blevins filed suit on behalf of the family of LeJeune, a deceased truck driver, against the A.O. Smith Corp. and 64 other companies.

    In the suit, Blevins alleges that the A.O. Smith Corp. and the other companies knowingly and maliciously manufactured and distributed asbestos-containing products throughout Jefferson County.
