McCown Paint and Supply of Texas has filed a breach of contract complaint against the owner of a Lumberton business, alleging he failed to pay a monthly lease amount for equipment.
Represented by Daniel D. Clayton of Beaumont, McCown claims Darrell Cunningham, who owns Cunningham's Collision and Customs, agreed to pay a lease amount of $1,159.28 on a monthly basis until the end of the lease term.
At the end of the lease term, McCown had the option to purchase the equipment for $1, the complaint filed Oct. 24 in Jefferson County District Court states.
But Cunningham failed to make payments to McCown, according to the suit.
"In addition, Plaintiff furnished parts and equipment to Defendant to maintain the leased equipment though not required to do so," the suit states.
McCown is seeking unspecified damages, plus prejudgment and post-judgment interest, attorney's fees, costs and other relief the court deems just.
The case has been assigned to Judge Milton Shuffield of the 136th District Court.
