A Jefferson County woman has filed suit against Texas Farm Bureau Underwriters and one of its agents, alleging damages to her home during Hurricane Ike were not covered under her insurance policy, although they should have been.
It was not until Donna Parker's home was damaged during the storm on Sept. 13 that she discovered her insurance policy did not include coverage against wind damage, even though she had requested it numerous times, according to the complaint filed Dec. 12 in Jefferson County Circuit Court.
"In fact, prior to Hurricane Ike, plaintiff received assurances from persons acting under the direction and control of Cody D. Woodul (the insurance agent) that her home was covered against damage caused by wind," the suit states.
Farm Bureau and Woodul breached their duties to provide insurance that protected Parker's residence against known and reasonably anticipated risks associated with hurricanes, she claims.
Parker is seeking actual, economic and consequential damages, pre- and post-judgment interest, attorney's fees, costs and other relief the court deems just.
Tom N. Kiehnhoff of Reaud, Morgan and Quinn in Beaumont will be representing her.
The case has been assigned to Judge Milton Shuffield of the 136th District Court.
