A railroad worker has filed suit against Econo-Rail Corporation and Trans-Global Solutions, alleging he was injured while working for the railroad.
James Walter Murray claims he suffered a shoulder injury while attempting to throw a defective switch, according to the complaint filed in Jan. 9 in Jefferson County District Court.
Murray was working for Kansas City Southern Railway Co. at the Port of Port Arthur on Jan. 11, 2007, when he suffered a temporarily debilitating injury, the suit states.
Because of his injury, Murray alleges he experienced physical pain, suffering and mental anguish, incurred lost earnings and benefits, suffered a physical impairment, paid medical expenses and was disfigured.
Econo-Rail and Trans-Global were negligent by failing to safely inspect, repair and maintain the switch, by failing to warn Murray about the defective switch, by failing to establish and enforce proper safety procedures and by failing to follow rules, regulations, codes and industry standards, according to the complaint.
Murray is seeking an unspecified judgment within the jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief to which he is entitled.
He is represented by Bristol Baxley of Rome, Arata and Baxley in Pearland.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
