This Just In: Recent civil suits filed in Jefferson County District Courts

  • David Charbonnet vs. Grand Oil & Gas Inc. et al

    PA - Cory Itkin, J - Gary Sanderson

    A Louisiana seaman has filed suit against his employers, alleging he did not receive proper care for his illness while offshore.
    David Charbonnet filed a personal injury suit under the Jones Act against Grand Oil and Gas, Laredo Offshore Services and Laredo Offshore Constructors on Jan. 23 in Jefferson County District Court.

    According to the original complaint, Charbonnet was working as a seaman on the L/B Petite in March 2007 when he began to experience severe stomach pains. The vessel is a Class 150 Lift Boat owned by Laredo Offshore for work on offshore drilling rigs and platforms.
    Charbonnet says he complained of the pains and requested medical attention while the vessel was off the shore of Jefferson County, but did not receive proper care, the suit states.

    Charbonnet claims he was later diagnosed with ulcerative colitis.

    Because he was not treated in a timely or proper fashion, Charbonnet sustained physical pain and mental anguish, according to the complaint.

    On July 16, 2007, the plaintiff was traveling westbound on I-10 when the defendant suddenly stopped on the highway, causing a pileup.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Keith McClinton vs. Union Pacific Railroad Co.

    PA – Bristol Baxley, J – Milton Shuffield

    On April 18, 2008, the plaintiff was injured when the handhold on defendant's rail car gave way, causing him to fall.

    The plaintiff alleges the defendant negligently failed to provide a safe workplace and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Mutual Hospitality Group Inc. vs. U.S. Cheema Inc. et al

    PA – Wyatt Snider, J – Gary Sanderson

    In January 2008, the plaintiffs were hired to manage the Beaumont Holiday Inn on 11th Street. The plaintiffs were fired recently and allege that they are owed 50 percent ownership of the company.

    The suit does not state when or why the plaintiffs' contract was terminated.

    They are suing for actual and consequential damages, plus all court costs.

  • Carla Mattox vs. City of Beaumont

    On March 25, 2008, the plaintiff was injured while undergoing a Beaumont Police department fitness test.

    Recruits have to pass the test for BPD consideration.

    The plaintiff fell while climbing down a ladder and broke her arm.

    She claims the ladder was unsafe and that she should have been better supervised.

    She is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    Individually and on behalf of her minor son, the plaintiff is suing the defendant for injuries her son sustained on Oct. 24, 2008.

    The child was working on top of his backyard fence when he lost his balance and reached for the power line.

    The plaintiffs claim the defendant was negligent for allowing the power lines to hang so low to their place of residence.

    They are suing for past and future mental anguish, lost wages, medical expenses and impairment.

    Individually and on behalf of her minor children, the plaintiff is suing the defendant injuries her children received on Sept. 25, 2007.

    The suit does not state what how the incident occurred.
