This Just In: Recent civil suits filed in Jefferson County District Courts

Feb. 24

  • Wyron Wells vs. Texas Windstorm Insurance Association et al

    PA – Steve Mostyn, J – Gary Sanderson

    The plaintiff is suing the insurance company and at least one of its claims adjusters for allegedly refusing to pay at least a portion of his Hurricane Ike claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    The plaintiff is seeking actual and consequential damages.

  • Reagan Bray vs. Uvalde Truck and Trailer et al

    On June 30, 2008, the plaintiff was driving northbound on Spur 215 when one of the corporate defendant's drivers allegedly blocked the lane, causing the plaintiff to strike the defendant's trailer.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Henry Lambert vs. Mitsubishi Caterpillar Forklift America et al

    PA – Steven Barkley, J – Gary Sanderson

    On Oct. 25, 2007, while working at a commercial metal plant off of College Street, the plaintiff was operating a defendant manufactured forklift.

    As he slowly lowered the boom to pick up a chain, the plaintiff alleges the boom moved too fast "and crushed his skull between the boom and the top of the cab.

    The plaintiff had left his seat to see if the chain was on the forks.

    The plaintiff is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    Merced Fernandez vs. Centerpoint Builders et al

    On Nov. 20, 2008, the plaintiff was working at the Beaumont Trace Apartments. As he stepped onto a truss, it broke and collapsed, causing him to fall to the ground.

    The plaintiff is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Damian Tristian and Sulene Romero vs. Tri-Supply Co. et al

    On Feb. 14 the plaintiffs were in an automobile collision with one of the corporate defendant's truck drivers while in Conroe.

    The suit does not state how the incident occurred.

    The plaintiffs allege the defendant driver negligently failed to keep a proper lookout and are suing for past and future mental anguish, lost wages, medical expenses and impairment.

    The plaintiff, on behalf of her deceased husband's estate, is suing 44 makers/distributers/users of asbestos products for allegedly conspiring to inflict her husband with an asbestos-related illness.

    The plaintiff is seeking punitive and exemplary damages, plus damages for Anthony Harris' mental anguish, lost wages, medical expenses and impairment.

  • Daniel Granger vs. C.L. Thomas Inc. and Speedy Stop Food Stores

    On July 11, 2007, the plaintiff ventured into the Washington Speedy Stop when he slipped in a puddle of "brown liquid" near the coffee/soda machine area.

    The plaintiff alleges the defendant negligently failed to maintain its premises and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    On Feb. 26, 2007, the plaintiff was traveling on Highway 69 when the defendant rear-ended him.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    On March 22, 2008, the plaintiff was staying at the Beaumont La Quinta when she tripped on a wet floor.

    On June 3, 2008, the plaintiff was traveling on I-10. When he was forced to stop for a construction zone, the defendant rear-ended him.

    The plaintiff alleges the defendant negligently failed to maintain its premises and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    On March 6, 2006, the plaintiff was serving on the plaintiffs' vessel when it collided with another barge, causing him to hit the shower wall.

    The plaintiff alleges the defendant's ship was unseaworthy and negligently failed to provide him with a safe workplace.

    He is suing for past and future mental anguish, lost wages, medical expenses and impairment.
