Woman sues resort after trip on sidewalk

GALVESTON – An Ellis County woman's stay at Galveston's San Luis Resort, Spa & Conference Center more than six months ago ended with a personal injury lawsuit against the beachfront hotel.

Dian Corbin of Italy says she was walking in the vicinity of the resort's rear entrance on July 8, 2008, when she lost her step along the pavement and fell.

"On the occasion in question, the defendant was guilty of negligence," court papers say. "The plaintiff was an invitee to whom the defendant owed a duty to use ordinary care, including the duty to inspect the premises and protect and safeguard the plaintiff from unreasonably dangerous conditions which the defendant knew or should have known and to warn the plaintiff of their existence."

Corbin filed the suit in Galveston County District Court on March 5.

The suit alleges the walkway, which was part of a circular pavestone driveway, appeared uneven and different from another exit off the roundabout.

"Had both ends of this circle drive been configured in this fashion, the plaintiff's incident would have been avoided," the complaint states.

The extent of Corbin's injuries was not specified, although the plaintiff claims she sustained serious and permanent injuries that rendered her unemployed.

Consequently, Corbin seeks damages for physical pain, suffering, mental anguish, disfigurement, impairment, medical expenses, and losses of earnings and earning capacity from the San Luis.

She did not demand a jury trial.

League City attorney Scott C. Krist is representing the plaintiff, and the case has been assigned to Galveston County 212nd District Court Judge Susan Criss.
