Grandmother sues university system over fall at college day care center


A Port Arthur woman says she suffered extensive injuries after she fell while dropping her granddaughter off at a child care center.

Linda Martinez filed a lawsuit Aug. 13 in Jefferson County District Court against Texas State University System and Lamar State College Port Arthur.

Martinez says she was dropping her granddaughter off at a child care center at the defendants' premises on Aug. 22, 2007.

"While attempting to exit the premises, the Plaintiff slipped and fell onto the floor," the suit states.

Because of her fall, Martinez suffered the loss of affection, solace, comfort, companionship, society, assistance and sexual relations with her husband, the complaint says. She also suffered and will continue to suffer physical pain, mental anguish, physical impairment, loss of wages and loss of earning capacity and incurred medical costs, according to the complaint.

She blames Texas State University System and Lamar State College Port Arthur for failing to warn of a dangerous condition and for failing to eliminate the risk of harm.

Martinez is seeking unliquidated damages, pre- and post-judgment interest, costs and other relief to which she may be entitled.

Ryan Douglas White and Jason L. Cansler of Brent Coon and Associates in Beaumont will be representing her.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
