  • Tobe Hardin et al vs. Foremost Lloyd's of Texas et al

    PA - Steve Mostyn, J - Dennis Powell

    The plaintiff is suing the insurance company and several of its adjusters for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendants are guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, impairment, lost earnings and pain, plus attorney's fees.

    On July 7, 2008, the plaintiff was riding his motorcycle on Main Street in Vidor when the defendant attempted to drive around a railroad crossing gate and struck him.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, impairment, lost earnings and pain, plus attorney's fees.

    On July 7, 2007, the plaintiff purchased a 2008 Ford F250 from the defendants.

    Since the purchase, the plaintiff claims he has had several problems with the vehicle and is suing under the "Lemon Law" and DTPA.

    He is seeking actual and consequential damages.

    On Sept. 2, 2007, the plaintiffs were shopping at Wal-Mart when Jennifer slipped on a spill in the produce aisle.

    John claims he broke his hand on their shopping cart when he attempted to catch his falling wife.

    They are suing for past and future mental anguish, impairment, lost earnings and pain, plus attorney's fees.
