This Just In: Recent civil suits filed in Jefferson County District Courts

Sept. 28

  • Nancy Williams vs. Grayson Arnold and Jason's Deli

    PA - Brent Goudarzi, J - Gary Sanderson

    On Oct. 5, 2007, the plaintiff was traveling on Old Jackson Highway when the defendant, while working for Jason's, ran a stop sign and struck her vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Waleed Khan et al vs. Texas Windstorm Insurance Association

    PA - Clint Basher, J - Donald Floyd

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

    On Dec, 19, 2008, the plaintiff was carrying heavy furniture when he injured his neck.

    The plaintiff alleges the defendant failed train him and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Richard Burton et al vs. Darlene Saunders

    On July 3, 2008, the plaintiffs were backing into a private driveway when they were hit by the defendant.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Ruby Clurksy vs. Motiva Enterprises et al

    PA - Tom Oxford, J - Donald Floyd

    A woman has filed suit against two companies after she says an employee accidentally lifted her off the ground with a backhoe.

    Ruby Clursky claims she was working for L.C. Personnel Inc. on Dec. 3 on property owned by Motiva Enterprises when the incident occurred.

    At the time of the incident, Clursky was standing near a backhoe that was being operated by an employee of ABClean.

    The suit names both Motiva and ABClean as defendants.

    "The backhoe operator fell asleep and when he woke up his jacket hung over the lever of the backhoe," the suit states. "The backhoe then caught the Plaintiff, Ruby Clursky, and lifted her off the ground and swung her back and forth resulting in the injuries and damages complained of herein."

    Because of the incident, Clursky says she experienced physical pain, suffering, mental anguish, loss of earning capacity and physical impairment and incurred medical expenses.

  • Peggy Davis vs. Raul Ortiz

    Individually and on behalf of her minor child, the plaintiff is suing the defendant for causing an automobile wreck on Oct. 25, 2008.

    The defendant allegedly ran a stop sign at 9th Avenue.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On Oct. 10, 2007, the plaintiff was a pedestrian when the defendant ran her over.

    On Oct. 6, 2007, the plaintiff hit a pot hole at the intersection of Ethel and Edmonds and injured herself and damaged her vehicle.

    The plaintiff is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.
