Oct. 5

  • Ricky Root et al vs. Farmers Insurance Exchange

    PA - Steve Mostyn, J - Gary Sanderson

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Elyse Thibodeaux vs. Kenneth Dillon Jr.

    PA - David Ferrell, J - Gary Sanderson

    On Oct. 10, 2008, the defendant allegedly caused an automobile collision with the defendant.

    The suit does not state where or how the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On March 16 the plaintiff was attempting to walk down a flight of stairs while carrying her grandchild when the handrail gave way and caused her to fall.

    The plaintiff alleges the defendant negligently failed to maintain its premises and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Earnest Sennet vs. Steinhagen Oil

    On March 27, 2008, the plaintiff was attempting to exit the defendant's premises when a malfunctioning door slammed on his ankle and caused him to fall.

    The plaintiff alleges the defendant negligently failed to maintain its premises and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Somer English vs. Jake Ahlgrim

    PA - Gordon Friesz, J - Gary Sanderson'

    On July 26 the plaintiff was attempting to make a left turn at the intersection of Central Mall Drive and Highway 365 when the defendant failed to yield the right-of-way and struck her vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Ginger Goates et al vs. Chevron USA

    PA - Keith Hyde, J - Donald Floyd

    The surviving spouse and children of a man who died have filed suit against Chevron, claiming the man was exposed to asbestos fibers during his work for the company.

    Ginger Goates, wife of Marvin Goates, and Carolyn Blackmon, Linda Dickinson, Katherine Goates and Jody Wilkerson, children of Marvin Goates, claim he died on Feb. 28, 2008, after he developed pulmonary asbestosis and lung cancer.

    They allege the diseases were caused from asbestos fibers that Marvin Goates inhaled while working as a pipefitter helper, insulator trainee and instrument mechanic at Gulf Oil Corporation in Port Arthur.

    The plaintiffs blame Chevron for causing the disease, saying the company knew about the dangers of asbestos but still allowed its employees to work around the products. In addition, Chevron failed to warn Marvin Goates about the dangers of asbestos exposure, the suit states.

    Marvin Goates' wife and children are seeking exemplary and punitive damages.

  • Lynda Guillory et al vs. ExxonMobil Corp et al

    PA - Keith Hyde, J - Bob Wortham

    The surviving children of a man who died have filed suit against ExxonMobil Corporation, Mobil Oil Corp. and Mobil Chemical Co., claiming the man was exposed to asbestos fibers during his work for the company.

    Lynda Guillory, Esther Newman, Carolyn Richmond, Janice Newman and Willie Newman, children of Ameal Newman, claim he died on Jan. 11, 2008, after he developed lung cancer.

    They allege the disease was caused from asbestos fibers that Ameal Newman inhaled while working as a pipefitter and welder at Mobil Oil in Port Arthur.

    Plaintiff Lynda Guillory, represented by Provost Umphrey attorney Bryan Blevins, filed a separate lawsuit against 31 companies on behalf of Newman on Oct. 1. Newman filed a suit prior to his death for a different asbestos-related disease.

    The plaintiffs are seeking exemplary and punitive damages, plus interest, costs and other relief to which they may be entitled.

  • Veola Forse vs. Texaco

    The surviving spouse and children of a deceased man have filed suit against Texaco, claiming the man was exposed to asbestos fibers during his work for the company.

    Veola Forse, wife of Floyd Forse, and his 10 children say he died on March 4, 2008, from an asbestos-related disease.

    The plaintiffs allege the disease was caused by asbestos fibers that Floyd Forse inhaled while working as a laborer, insulator helper, machinist helper, stillman and press operator at Texaco in Port Arthur.

    They blame Texaco for causing the disease, alleging the company knew about the dangers of asbestos but still allowed its employees to work around the products. In addition, Texaco failed to warn Floyd Forse about the dangers of asbestos exposure, the suit states.

    Veola Forse and her children are seeking exemplary and punitive damages.

  • Michael Miller vs. Cal Dive International et al

    The plaintiff, a seaman, is suing the defendant under the Jones Act for injuries he received on Aug. 31.

    The suit does not state where or how he was injured.

    The plaintiff is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Pamela Sims et al vs. LTHM Groves Operations et al

    A Port Arthur woman and her husband have filed suit against a Mid-Jefferson County hospital alleging she was severely burned by heating apd.

    Pamela Sims, and her husband, Brian, filed suit against LTHM Groves-Operations doing business as Renaissance Hospital-Groves, Renaissance Hospital Inc. and Renaissance Healthcare Systems for what she claims were second- and third-degree burns after a physician attempted to treat suspected blood clots in the woman's right leg with a heating pad.

    Pamela Sims was hospitalized at the Renaissance Hospital in Groves on Nov. 15, 2007, after undergoing bilateral knee replacements earlier in the year.

    On Nov. 4, 2008, the plaintiff was traveling on I-10 when a Sheriff's Patrol Unit lost control while traveling at a high rate of speed and spun into his vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.
